Terms and Conditions

1. Scope of Service

Aristocade provides a platform for artists ("Sellers") to showcase and sell work to collectors ("Buyers"). We act as a venue; the actual contract for sale is directly between the Buyer and the Seller.

2. Account Registration & Cancellation

• Eligibility: Impersonating another individual is specifically prohibited.
• Responsibility: You are responsible for safeguarding credentials and all activities under your account.
• Cancellation: Users may cancel subscriptions at any time via the dashboard.
• Data Retention: Data is retained for administrative purposes unless a formal deletion request is submitted.

3. Subscription Plans & Commissions

Aristocade offers three tiers of monthly subscription plans for Artists.

• Modifications: Pricing and plan names are subject to change at our sole discretion.
• Commissions: Percentages vary by plan and are subject to change.
• Pricing: Artists set retail prices; final customer prices include commissions and fulfillment costs.
• Refunds: All subscription payments and commissions are non-refundable.

4. Buying and Selling

• Pricing: Sellers set prices, which are subject to applicable taxes and shipping fees.
• Payments: Processed via third parties (e.g., Stripe/PayPal); users agree to their terms.
• Shipping: Responsibilities and costs must be clearly defined in individual listings.

5. Intellectual Property & Copyright

• Ownership: Artists retain ownership of the intellectual property they upload.
• Enforcement: Artists are solely responsible for enforcing their own copyrights.
• Platform License: Uploading art grants Aristocade a limited, worldwide license to display work for marketing and sales purposes.

6. Prohibited Content & Conduct

6.1 Adult and Explicit Content Policy

• Permitted Nudity: Non-explicit depictions (e.g., breasts) are allowed but must be marked as "Mature Content".
• Tagging: Explicit tagging of images is not allowed.
• Exploitation: Sexualized content involving minors is strictly prohibited and will be reported to authorities.

6.2 Technical & General Restrictions

Users may not upload malicious code, use bots for scraping, or bypass security features. We reserve the sole right to determine violations and remove content without notice.

7. Taxes and Refunds

• Sales Tax: Artists are independent contractors responsible for all tax obligations.
• Artist Refunds: Artists must establish and manage their own refund policies.
• Platform Role: Aristocade does not facilitate or fund refunds for artwork.

8. Limitation of Liability

To the maximum extent permitted by law, Aristocade shall not be liable for indirect, incidental, or consequential damages resulting from the use of our services.

9. Termination

We reserve the right to suspend or terminate accounts for violations, specifically regarding prohibited content or user reports.

10. Governing Law

These Terms are governed by the laws of Utah.
